FEES IN RESPECT OF UNFAIR DISMISSAL AND WRONGFUL DISMISSAL EMPLOYMENT TRIBUNAL CLAIMS

Average fees for claims in the tribunal would be as follows:-

Application Average Fee
A straightforward application for unfair dismissal, including a claim for notice pay or unpaid salary £5,000 to £7,000 plus VAT
A more complex matter including constructive dismissal and a straightforward discrimination claim £6,000 to £10,000 plus VAT
A complex claim for unfair dismissal or constructive dismissal including a substantial claim for discrimination or a whistleblowing claim £8,000 – £20,000 plus VAT

The fees quoted above include the following:-

  • Taking initial instructions
  • Reviewing papers
  • Preparing tribunal documentation (including ET1/ ET3) and further details
  • Liaising with the tribunal and the other party
  • Preparing bundle of documents
  • Preparing witness statements
  • Preparing schedule of loss/ counter schedule of loss

Additional fees will be incurred for the following:-

  • Preparing for and attending preliminary hearings
  • Making or opposing additional applications for orders from the tribunal (other than those made in the ET1/ ET3)
  • Preparing for and attending a separate remedy hearing

Disbursements

In the event that we instruct a Barrister to represent you in tribunal, additional fees will be payable. The fee will depend on the seniority of the barrister and the fee quote provided by chambers. These fees will be agreed with you before the barrister is instructed.

Timescales

It is very difficult to predict the timescales in employment tribunal claims as much depends on the availability of the tribunal judges. We would estimate that the vast majority of claims are concluded within 6 to 12 months of the claim being submitted.

FEES IN RESPECT OF LICENSING APPLICATIONS

Average fees for applications made under the Licensing Act 2003 would be as follows:-

New Premises Licence £950 – £1,250 plus VAT
Major Variation Application £950 – £1,250 plus VAT
Minor Variation Application £300 – £450 plus VAT
Application to change DPS £150 plus VAT
Application to transfer Premises Licence £150 plus VAT
Temporary Event Notice £175 plus VAT
Personal Licence Application £150 plus VAT

In the event that representations are received, further fees will be incurred in negotiating settlement and/ or attending a hearing before the licensing sub-committee. These fees will be incurred at usual hourly rates.

Additional fees will be payable in respect of:-

  • Application fees (payable to the local authority – no VAT)
  • Advertising costs (where appropriate)
  • Travel expenses

Please note that the average fees quoted above do not include pre-negotiation with responsible bodies or attendance at consultation meetings in advance of submitting an application.
