Potential implementation: October 2026
What is the position now?
In most cases, a worker or employee must start an employment tribunal claim within three months of the issue they are complaining about. This deadline can be slightly extended if they go through ACAS Early Conciliation.
What is changing?
The government plans to double the main time limit for most employment tribunal claims to six months.
What does this mean for employers?
Employers may face claims much later than they do now. This means records, emails and evidence will need to be kept for longer and potential disputes may take more time to resolve.
As at Feb 26
