Sexual Harassment – Preventative Duty

What is the position now?

Since October 2024, employers have had a legal responsibility to take sensible and practical steps to stop sexual harassment at work.

What is changing?

The law is expected to raise the bar. Employers will need to show that they have taken all reasonable steps, not just some, to prevent sexual harassment from happening.

What does this mean for employers?

Employers will be expected to be more proactive and thorough. Having basic policies alone is unlikely to be enough – businesses will need to actively assess risks, train staff and put effective measures in place to prevent problems before they arise.
